In 1792, he was appointed a captain of the Madison County militia. In 1791, the Trustees of Harrodsburg again brought suit against Stagner, but judgement was made in favor of Stagner. In 1789 the Trustees of Harrodsburg brought suit against James Barney Stagner. James Barney Stagner was residing in Madison County, Kentucky, by 1788. The following month, 27 March 1784, when John Devine and Anne Davis were married, Barney Stagner signed as security. On 7 February 1784 Barney Stagner served as security on the marriage bond of Patrick Carmichael and Mary Arthur. Barney may have been residing on this land in 1787 when he served as bondsman at his brother-in-law’s marriage. No subsequent records for this land have been located. On 14 February 1780 James Barney Stagner, as heir of John Barney Stagner, deceased, claimed 1400 acres of land, based on his father's residence, in 1776, on unpatented land on Cartright’s Creek, on Beech fork of Salt River, in present Mercer County, Kentucky. He was listed as a soldier in Captain John Holder’s Company, 10 June 1779, as a defender of the fort at Boonesborough. On 24 December 1778, Lawrence Thompson claimed 100 acres on the “waters of Barney Stagner’s Branch, adjacent to John Hunt Prather’s entry.” Existing evidence suggests that James Barney Stagner remained in North Carolina until late 1778 or early 1779. Finally, James Barney Stagner appears on the Rowan County tax list for 1778 in Capt. It stands to reason that Letters of Administration would be granted to a resident who would be in a position to settle debts and arrange other matters pertaining to the estate. Note also that Letters of Administration were granted to James Barney Stagner on his father’s estate on 5 November 1777. In fact, judging from the wording of John Barney Stagner's will, 1774, argument can be made that James Barney Stagner and his mother, Elizabeth, remained in North Carolina. No proof has been found to show that James Barney Stagner went with his father to Boonesborough, Kentucky, in 1775. James Barney Stagner, called Barney, son of John Barney and Elizabeth Stagner, was born about 1753.
